Seek Texas is a book about Texas intended to encourage a love for learning about Texas with a promotional contest of intellect and skill. The book contains clues which contest participants may use to find a hidden treasure and claim the prize. In addition, a portion of each sale of the book will benefit an historic Texas charity.

WHAT IS SEEK TEXAS?
THE "TREASURE"
The "Treasure" is a 3-inch metal medallion enclosed inside a weather-resistant box located in a public place. The Treasure is in a location legally accessible by the public, it is not buried, nor located on private property. The participant who first finds the Treasure, in compliance with all the Official Rules, will be the Winner of the Prize.
The "Prize"
- Ten (10) American Eagle One Ounce Gold Uncirculated Coins (various dates from 1986 to 2025) ("Gold Eagles"); and
- A cashier’s check payable to the winner which is equal to the entire current balance of the Winner Savings Account (defined below) as of the End Date.

HOW TO PARTICIPATE IN THIS PROMOTION (the “TREASURE HUNT”)
Obtain a copy of the book "SEEK TEXAS" (the "BOOK"). Each copy of the Book has a Registration Number (Page 50). To participate in the Treasure Hunt, you must register your Book’s Registration Number on the website www.SeekTexas.com. Contained within the Book are clues to find hidden Treasure that, when solved, will direct you to the location of the hidden Treasure. The Treasure is in a public place within the State of Texas. The first person to locate the Treasure, using their intellect and skill, who satisfies the eligibility requirements and follows the redemption instructions set forth below, will, upon verification by the Arbiter, be awarded the Prize. The potential Winner must submit the claim personally; submissions through agents or third parties are not valid. The Book will be available to the public on June 2, 2025. The Treasure Hunt will run until the Treasure is found and Winner verified by the Arbiter, or until June 1, 2028 (the "End Date"), whichever is sooner.

WINNER SAVINGS ACCOUNT
Sponsor will open a "WINNER SAVINGS ACCOUNT" at an FDIC Insured Institution located in the State of Texas. For every Book obtained and officially registered on the website www.SeekTexas.com, Sponsor will add [five US Dollars ($5.00)] to the Savings Account. The most current balance of the Savings Account reasonably available to Sponsor will be updated and provided on the website www.SeekTexas.com.

CHARITABLE BENEFICIARY SAVINGS ACCOUNT
Sponsor will open a "CHARITABLE BENEFICIARY SAVINGS ACCOUNT" at an FDIC Insured Institution located in the State of Texas. For every Book obtained and officially registered on the website www.SeekTexas.com, Sponsor will add [one US Dollar ($1.00)] to the Charitable Beneficiary Savings Account. The Charitable Beneficiary Savings Account is separate from, independent of, and in addition to the Savings Account set forth in Section (2). The most current balance of the Charitable Beneficiary Savings Account reasonably available to Sponsor will also be updated and provided on the website www.SeekTexas.com. Upon conclusion of the contest at the End Date, the then-current balance of the Charitable Beneficiary Savings Account will be distributed to the "Remember the Alamo Foundation", a 501(c)(3) non-profit organization that provides support exclusively for the Alamo and its preservation, educational outreach, and public programs. In the event the Arbiter does not declare a winner prior to June 1, 2028, the then-current balance of the Winner Savings Account will also be distributed to the "Remember the Alamo Foundation", a 501(c)(3) nonprofit organization.

ELIGIBILITY
The contest is open to legal residents of the 50 United States and its territories, except where prohibited by law. Winner as determined by the Arbiter defined in Section (6) will be required to execute an affidavit confirming compliance with these eligibility requirements. Employees of the Sponsor, the Arbiter, their immediate families and household members (related or not), and agents participating in the creation of this Treasure Hunt are not eligible to enter.

SOLUTION
The Solution to the location of the Treasure in this Book is recorded and maintained in a secure location. The Solution will be revealed after the End Date either on the website or in a subsequent publication.

ARBITER
Sponsor, at its sole discretion, appoints an Independent Arbiter ("Arbiter"). The functions of the Arbiter include, but are not limited to (a) attending the hiding of the Treasure in the Treasure’s Hidden Location, thereby attesting the Treasure is real, tangible, and available to all Participants; (b) attesting that the Treasure’s hidden location is a safe, public place available to the Participant at any time; (c) attending the placement of and attesting to (10) Gold Eagles reside in a Texas safe deposit box; (d) ensuring the Winner properly followed Section (7) PARTICIPANT CONDUCT; and (e) declaring the Winner of the Treasure Hunt.

PARTICIPANT CONDUCT
Arbiter reserves the right, in its sole discretion, to disqualify any Participant who (a) violates these rules; (b) tampers with any required process or the participation in, or operation of, the Treasure Hunt, or (c) acts in a disorderly manner with the intent to upset, abuse, threaten, or harass any other Participant or person, including but not limited to pending criminal prosecution, civil litigation, or any other unresolved legal dispute related to the Winner’s pursuit of the Treasure. The Treasure and all of the relevant clues are located in safe and publicly-accessible areas. The Treasure is not in a dangerous location (e.g. underwater, cave, building ledge), or on private property. Destruction of, trespassing on, or otherwise disrespecting any real or personal property is unnecessary to find the Treasure or otherwise participate, any such destruction, trespass, or otherwise disrespect, is prohibited. Any disputes raised by the owner of personal or real property, will be determined by the Arbiter, in his or her sole discretion. Sponsor expressly forbids any such conduct. Participant agrees that he/she/they will not use any artificial intelligence to obtain, or solve any clues required to obtain, the Treasure. By participating, Participant agrees to be bound by these Official Rules and decisions of the Arbiter, which shall be final in all respects on all aspects to the Treasure Hunt. Arbiter shall have complete discretion to interpret these Official Rules and any other aspect of the Treasure Hunt, and expressly reserves the right to award the prize to anyone who in the Arbiter’s discretion is in breach of these Official Rules or otherwise fails satisfactorily to establish their eligibility to win.

REDEMPTION INSTRUCTIONS
If you find the Treasure before June 1, 2028, you must initiate redemption within 30 days of finding it. If the Arbiter discovers the Treasure missing from its hiding place for over 30 days, the Treasure cannot be redeemed. Upon finding the Treasure, within 30 days, follow the instructions on the back of the Treasure. You may be asked to provide your solution to the puzzles and clues which led you to the location where you found the Treasure and execute an affidavit of eligibility and liability/publicity release (where legal), which includes matching your Registration Number with the Book you purchased. If your responses are verified as accurate, and it is determined that you used your intellect and skill to solve the Treasure Hunt, provided you fully complied with the Official Rules and are in all other respects eligible to receive the Prize, you will be declared the Winner. You will be asked to provide your name, address, and all other contact information. Winner must return the affidavit of eligibility and liability/publicity release within twenty-one (21) days of first attempted notification of verification. For a Winner who is younger than the age of majority, Prize will be awarded in the Winner’s name to his/her parent or legal guardian, and affidavits and releases must be signed by the Winner’s parent or legal guardian. Winner must give Sponsor permission to publicize Winner’s name and hometown as a condition of receiving the Prize, unless prohibited by law. Winner may also be required to use his/her name and submissions in advertising and marketing materials in all media in perpetuity, and may be required to participate in publicity events, except where prohibited by law. IRS Regulations require Sponsor to issue a 1099 tax form to anyone receiving the Prize available in this contest.

COLLABORATIONS
The Prize may be awarded solely to the participant identified with the Registration Number for that participant’s Book. If you have collaborated in your efforts with other persons, you will be fully responsible for dividing the Prize among such collaborators. Neither the Sponsor, the Arbiter, nor any of their agents or affiliates will be responsible for making such determinations or delivering the Prize to any other party or parties, and by participating in the Treasure Hunt you hereby release, hold harmless, and indemnify Sponsor and Arbiter from any liability in connection therewith, and agree to reimburse Sponsor and the Arbiter for any costs or expenses, including legal expenses, incurred by them in relation to same.

GENERAL
All materials and submissions to Sponsor and Arbiter become property of the Sponsor and will not be returned. Sponsor and Arbiter accept no liability for submissions, correspondence or attempted redemptions that are late, lost, or otherwise misdirected, or not submitted in accordance with these Official Rules. If no Winner is declared by June 1, 2028, the entire balance of the Savings Account and the (10) Gold Eagles will be donated to the "Remember the Alamo Foundation", a 501(c)(3) non-profit organization that provides support exclusively for the Alamo and its preservation, educational outreach, and public programs. Sponsor and Arbiter have made extensive efforts and taken reasonable steps to ensure that the Treasure remains where it is hidden until found by participants in the Contest. Sponsor and Arbiter will also, at various times during the promotion period, attempt to confirm that the Treasure remains in its hidden location. However, the Treasure may be moved by forces, including human intervention (intentional and unintentional) as well as force majeure events, over which Sponsor and Arbiter have no control. Sponsor and Arbiter disclaim all liability if, due to forces outside its control, the Treasure is moved from its location. Sponsor and Arbiter may or may not, in its discretion, replace the Treasure that has been moved but remains unclaimed with new Treasure.

ADDITIONAL LIMITATIONS
By entering, participants (a) agree to be bound by the Official Rules and decisions of the Sponsor which are final and binding in all respects; (b) agree to release Sponsor, Arbiter and agents from any and all liability, loss, damage or injury resulting from participation in the Treasure Hunt and searching for the Treasure, as well as awarding, receipt, possession, use and/or misuse of any prize awarded herein and acknowledge that Sponsor, Arbiter and agents have neither made nor are in any manner responsible or liable for any warranty, representation, or guarantee, express or implied, in fact or in law, relative to any prize; and (c) consent to use of his/her name, photograph (in any form) and/or likeness for advertising and promotional purposes without additional compensation, unless prohibited by law.

DISPUTES and ARBITRATION
This Treasure Hunt is governed by the laws of the United States and the laws of the State of Texas, without respect to conflicts of law doctrines between competing states’ laws. As a condition of participating in this Treasure Hunt, participants agree that any/all disputes which cannot be resolved between the parties and causes of action arising out of or in connection with this Treasure Hunt, shall be resolved individually, without resort to any form of class action. Any dispute, claim or controversy of any kind arising out of or relating to these Official Rules or the Treasure Hunt, including issues of arbitrability, shall be determined by final and binding arbitration administered by the American Arbitration Association ("AAA") pursuant to the AAA Commercial Arbitration Rules. The Arbitration shall occur in either Dallas, Travis, or Tarrant County, Texas, in the English language and shall be confidential. This arbitration agreement shall survive the termination of this agreement and is an independent agreement. Further, in any such dispute, under no circumstances will participants be permitted to obtain awards for, and hereby waive all rights to claim punitive, incidental or consequential damages, including attorney’s fees, other than participant’s actual out-of-pocket expenses (e.g. costs associated with entering), and participant further waives all rights to have damages multiplied or increased.

PUBLICATION OF WINNER
After the End Date of the Treasure Hunt, the Winner will be published on the website www.SeekTexas.com.
